Magistrate Court

Thank you for visiting the Lumpkin County Magistrate Court website. It is our goal to serve the citizens of Lumpkin County by providing justice to all parties. We are also committed to providing useful information about our court and about the functions we provide. Magistrate Court is the place to file if you are attempting to collect a “small claim,” that is a debt or other money obligation of $15,000 or less; or if you are a landlord attempting to evict a tenant, or a tenant responding to an eviction notice. In addition, the Magistrate Court is the place to file garnishment proceedings; to obtain an order to sell an abandoned motor vehicle or mobile home, to obtain possession of certain personal property and to request an arrest warrant or a good behavior bond. The Magistrate Court also handles the prosecution of county ordinance violations and certain other misdemeanors. The jurisdiction of our court is provided in O.C.G.A. § 15-10-2.

On this website you will find forms and information designed to help streamline your interactions with the legal system. We must mention that the judges and clerks at the Lumpkin County Magistrate Court cannot give you legal assistance or legal advice. The forms and information included here are not intended to be a substitute for legal advice. Instead, we encourage all parties to seek the advice of an attorney. The forms are intended to be printed and filed in person at the Clerk’s Office. To file online, please visit the website shown on this page, which has fillable forms on that site. The site charges an additional $20 for online filing.

All are welcome to come in person to our office located at the Justice Center in Dahlonega, and we will be happy to assist you to the extent our duties and obligations allow. Civil questions are directed to the Clerk of Superior Court. For criminal case questions, including good-behavior bond hearings, you should call or report to the Magistrate Court Clerk. The phone numbers for these are provided on the contact portion of this page. Thank you for your time in visiting this site and we wish you the best in whatever legal process in which you are involved.
